1. About these terms

These Terms of Use govern your access to and use of www.medfoods.co (the "Website"), operated by Medfoods DMCC, registered in the Dubai Multi Commodities Centre, UAE ("Medfoods", "we", "us", "our"). By using the Website you accept these terms. If you do not agree, please do not use the Website.

2. Purpose of the Website

The Website provides general information about Medfoods, our group companies, the brands we represent and distribute, and our services. It is intended for business users. Nothing on the Website is an offer to sell, and no contract for goods or services is formed through the Website. All supply is subject to separate written agreements or our standard terms of trade.

3. Information on the Website

We aim to keep the Website accurate and up to date, but the content is provided for general information only. Product information, specifications, availability, packaging and imagery may change and may vary by market. We make no warranty that the content is complete, accurate or current, and you should not rely on it without confirming with us directly.

4. Brands and trade marks

Brand names, logos, product names and trade marks shown on the Website, including on our Brands page (such as Mondelez, FrieslandCampina, Red Bull, Kellogg's, Energizer and Arla), belong to their respective owners. Their appearance on the Website shows a commercial relationship or products we handle; it does not imply that the owner endorses Medfoods beyond that relationship, and it does not grant you any licence to use them. The Medfoods name and logo are our trade marks.

5. Intellectual property

All content on the Website, including text, design, graphics, photographs and layout, is owned by or licensed to Medfoods and is protected by copyright and other intellectual property laws. You may view and print pages for your own internal business reference. You may not copy, reproduce, republish, modify or commercially exploit any content without our prior written permission.

6. Acceptable use

You agree not to:

  • use the Website for any unlawful or fraudulent purpose;
  • attempt to gain unauthorised access to the Website, its server or any connected system;
  • introduce viruses, malware or other harmful material;
  • scrape, harvest or data-mine the Website by automated means without our consent;
  • impersonate Medfoods or any of our staff or partners, or misrepresent a relationship with us.

7. Enquiries and submissions

If you send us information through the Website (for example a partnership or supply enquiry), you confirm that it is accurate and that you are authorised to share it. We are under no obligation to respond to or act on any enquiry. Please do not send confidential information unless we have agreed to receive it under a confidentiality agreement. Our use of personal data is described in our Privacy Policy.

8. Third-party links

The Website may link to websites operated by others, including brand owners and partners. We have no control over those websites and accept no responsibility for their content, security or privacy practices.

9. Partner portal

Access to our partner ERP portal is limited to authorised users. You must keep your login details confidential and tell us promptly at info@medfoods.co if you believe they have been compromised. Use of the portal is also subject to any terms agreed with you separately.

10. Availability

We do not guarantee that the Website will always be available or uninterrupted. We may suspend, withdraw or change any part of the Website without notice.

11. Limitation of liability

To the fullest extent permitted by law, we exclude all warranties and conditions relating to the Website and its content. We will not be liable for any loss or damage, whether in contract, tort (including negligence) or otherwise, arising from your use of or reliance on the Website, including loss of profit, revenue, business, goodwill or data, or any indirect or consequential loss.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

12. Changes to these terms

We may revise these terms at any time by updating this page. Please check it periodically; continued use of the Website means you accept the current terms.

13. Governing law and jurisdiction

These terms and any dispute arising from them are governed by the laws of England and Wales / the Emirate of Dubai and the federal laws of the UAE as applied in the DIFC. The courts of England and Wales / Dubai will have exclusive jurisdiction.
